Deliver the Notice (give notice)

After you fill out the right type of Noticesomeone 18 or older must deliver the Notice to your tenants. 

There are 3 ways to deliver a Notice

Hand deliver the Notice. This is when you, or someone else 18 or older, hands the Notice to one of the tenants.

Give the Notice to another adult in the home or where your tenant works and mail a copy to the tenant. The tenant's deadline to do what the Notice says doesn't start until the day after the Notice is mailed.

Post and mail the Notice. This is when you, or someone else 18 or older, posts a copy of the Notice on the home where your tenant lives and mails a copy to the tenant. The tenant's deadline to do what the Notice says doesn't start until the day after the Notice is mailed.

How to deliver the Notice

  • Decide if you'll deliver the Notice or if you'll have someone else do it

    You can deliver the Notice yourself or have someone else do it for you.   

    Whoever delivers the Notice must be:  

    • 18 or over

    They can be: 

    • Someone you know 

    • A family member

    • A professional process server you hire 

  • Give your tenant the Notice

    Hand the Notice to the tenant

    The person delivering the Notice hands the tenant a copy of the Notice.

    If you are giving your tenant a 15-day Notice to Pay or Quit, you must also give your tenant a blank Declaration of COVID-19-Related Financial Distress.

    If the tenant isn't at home 

    1. You can either

    • Leave a copy of the Notice with another person 18 or older at the home or where they work 
    • Post (tape) a copy of the Notice on the rental home 

    2. Then, mail a copy to the tenant

  • Write down the details of when, where, and how the Notice was delivered

    Whoever delivers the Notice will need to write the following on a piece of paper:

    The name of the Notice (for example, 3-day Notice to Quit) and either

    • The date the Notice was handed to the tenant
    • The date(s) the Notice was handed to an adult at the tenant's home or work (along with the person's name or description) and mailed to the tenant
    • The date(s) the Notice was posted and mailed

    This exact statement "I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct."

    Whoever delivered the Notice should date and sign that paper

    Keep this piece of paper for your records. If you start an eviction court case, you'll need to attach a copy of it to the forms you'll file with the court.

What’s next?

Once you've served the Notice to your tenant, you'll have to see if they do what the Notice asks. If they don't, you can start an eviction case with the court.
