California Courts of Appeal

Step 7: After the appellate court's decision

Step 7: After the appellate court's decision

After the Court of Appeal makes a decision, you have a few options for what to do next.

Choose one to learn more:

  • Petition for rehearing

Either side can ask the Court of Appeal to reconsider the decision by filing a petition for rehearing. This is used to point out mistakes the court made in its opinion.

  • Petition for review

Either side can ask the California Supreme Court to review the decision by filing a petition for review. The Supreme Court only agrees to hear a small number of cases.

  • Remittitur

This is the final step in the appeals process. It means the case is officially over in the Court of Appeal and returns to the trial court.
