COVID-19 rental debt in small claims

Starting in November 2021, landlords can sue for COVID-19 rental debt in small claims court.

Landlords can sue for COVID-19 rental debt in small claims without a dollar limit. Landlords can

  • Sue for more than the $6,250 or $12,500 limits
  • File as many COVID-19 rental debt cases as they need 

COVID-19 rental debt is rent and other payments required under the rental agreement, like utilities or parking fees, that came due between March 1, 2020 to September 30, 2021.

Rental assistance may be available. 

You and your tenants may qualify for the state’s Rent Relief program. If your tenant qualifies, you may receive 100% of the amount your tenant owes.
