How to serve papers by mail

  • Choose a server

    You can't serve papers yourself. Ask another adult to mail the papers. This is your server.

    Your server must be:

    • 18 or over

    • Not part of your case

    Your server can be someone you know or a professional process server you hire.

  • Have your server mail the papers

    Your server mails the papers to your spouse or partner using regular first class mail. If they have a lawyer, mail the papers to their lawyer.

    Your server should note the date they mailed the papers. They need this information to fill out the Proof of Service form.

  • Fill out Proof of Service form

    You can use Proof of Service by Mail (form FL-335).

    It helps if you fill in the top part of the form with the case and court information.

    Your server can then fill in the information about how, when, and where they served the papers. Your server must then sign the form.

  • Keep the Proof of Service

    Keep the Proof of Service for your records in case you need to prove you served the forms.

    If you don't get a response or get an incomplete response, there's a court process you can use to request that the judge order your spouse to respond or give complete responses. Learn what to do if your spouse doesn't respond

What's next?

Once you've served the form interrogatories, you've completed the process of requesting information this way. Your spouse has 30 days to answer.

 

When you receive a response, you'll review it to make sure it's complete and then use the answers as part of the preparation for your trial.

 

If the answers are not complete or if you don't receive a response at all, then you can use a court process to require the other person to answer.
