Elder or dependent adult abuse restraining order forms

All California courts use the same basic set of forms for elder and dependent adult abuse restraining orders. You can find the most commonly-used forms on this page.

Forms for the person asking for the restraining order

Fill and file forms to ask for a restraining order and get a court date, Then, have a copy of the forms delivered (served) to the other side.

Temporary Restraining Order (CLETS-TCH)	EA-110	Will tell you which, if any, temporary restraining orders (TROs) the judge signed.
Confidential CLETS Information	CLETS-001	Fill out when you file your request for a restraining order. Gives information about your case to all law enforcement agencies through a computerized database.
Attachment	MC-025	Use if you need more room when you fill out your Request.
Civil Case Cover Sheet	CM-010	Required by most courts to when you file any new civil case.
Declaration OR Attached Declaration	MC-030 Or MC-031	Use to give more information or for witness statements.
Proof of Personal Service	EA-200	Use to prove that you gave the person to be restrained a copy of the petition, notice of court hearing and temporary restraining order in person.	How to serve the request
Proof of Service of Order After Hearing by Mail	EA-260	Usually, the protected person must serve papers in person, but in some situations, the restraining order after hearing, on Form EA-130, you are legally allowed to serve by mail. Elder or Dependent Adult Abuse Restraining Order After Hearing (CLETS — EAR or EAF)	EA-130	If the judge grants any restraining orders, they will sign this form.
Response to Request for Elder or Dependent Adult Abuse Restraining Orders	EA-120	Leave blank and serve on restrained person with the TRO (Form EA-120).
Proof of Firearms Turned In, Sold, or Stored	EA-800	Leave blank and serve on restrained person with the TRO (Form EA-120).

A blank Response to Request to Renew Restraining Order	EA-720	Leave blank. Serve it with your request. It is for the restrained person to use if they decide to file a response.
Proof of Personal Service	EA-200	Use this form to prove to the court that the restrained person has been served in person.	How to serve the request
Order Renewing Elder or Dependent Adult Abuse Restraining Order	EA-730	Attach this form to EA-130 and give it to the court clerk to renew the restraining order.
Proof of Service of Order After Hearing by Mail	EA-260	Ask the server for Proof of service of order after hearing by mail	Serve the order to renew
