Eviction Forms

All California courts use the same basic set of forms for eviction. You can find the most commonly-used forms on this page. If you are not sure which forms to use, talk to your Self-Help Center or a lawyer.

 

Some courts have special local forms too. To see if you will need any special local forms, contact your court clerk or check your court’s website.

Notices are not court forms. You can find standard blank Notices in legal self-help books at the library, from an attorney, or possibly from your local court Self-Help Center, or online. Find out more about the different types of Notices.

Forms for the landlord

Complaint - Unlawful Detainer UD-100 Starts an eviction case and tells the tenant all the issues the landlord wants to include in a judgment against them. Start an eviction 
Civil Case Cover Sheet CM-010 Tells the court some basic information about a case being filed. Filed at the beginning of all civil cases except family law cases.  
Summons - Unlawful Detainer-Eviction SUM-130

Tells a tenant that the landlord has started a court case to evict the tenant and what can happen if a response is not filed in 5 days.

 
Plaintiff’s Mandatory Cover Sheet and Supplemental Allegations – Unlawful Detainer UD-101 Tells the court required information about COVID-19-related issues as a landlord in an eviction case. You must file this with the court and deliver a copy to (serve) the tenant.  

Option: Prejudgment Claim of Right to Possession

CP10.5 A landlord can have the sheriff or process server  deliver this with the Complaint and Summons. It lets any unknown adults who live in the rental unit know about the eviction and their right to join the case.   
Proof of Service of Summons POS-010

Tells the court that you had a summons or other legal papers delivered to (served on) the tenant. Lists the papers that were served and tells who they were served on, where, when, and how they were served, and who served them.

Serve your Summons and Complaint


Fill out more forms if you need a fee waiver. There's a $240-$450 filing fee to file an eviction case. If you can't afford the fee, you can ask for a fee waiver.

If your tenant filed an Answer, you can ask for a trial.

Many courts have local forms you can use to ask for a default judgment. Before filling out these forms, contact your court clerk or check your court’s website to find out of they have other forms you can use.

Default judgment for possession of your property

If your tenant does not file any response by the deadline, you can ask for a default. Once you have a default, you can ask for a Clerk's Judgment of Possession to get your property back. You won't be able to include back rent in this Clerk's Judgment for Possession. You can ask for the money you're owed in a separate default money judgment.

Request for Entry of Default  CIV-100 Asks the court to enter a "default" against the tenant because they failed to file an Answer or other responsive document in the case. Can be used to ask for a default alone, or also a default judgment. Ask for a trial or a default judgment
Judgment-Unlawful Detainer UD-110 States the judge's decision in your case.  
Writ of Execution for Possession of Real Property EJ-130 Tells the sheriff they can enforce a judgment, evict your tenant.  
Verification by Landlord Regarding Rental Assistance - Unlawful Detainer   UD-120 Tells the court that you haven’t received rental assistance or other financial help when evicting a tenant due to back rent or other money owed.  

 

Default judgment for money owed

If you already have a default judgment for possession and you're owed money, you can ask for a judgment to get the money owed.

Request for Court Judgment CIV-100 This is the same form used to ask for the Clerk's Judgment of Possession. To ask for the rent you're owed, check the "By court" box. Ask for a default judgment for money owed
Declaration for Default Judgment by Court  UD-116 Proves that the amount you're asking for is what the tenant owes.  
Writ of Execution (Money Judgment)  EJ-130 Gives the sheriff permission to take the money the tenant owes you from their paycheck, bank account, or other places.   
Verification by Landlord Regarding Rental Assistance - Unlawful Detainer  UD-120 Tells the court that you haven’t received rental assistance or other financial help when evicting a tenant due to back rent or other money owed.  

If your tenant moved out before you go to trial or you reached an agreement, you can ask the judge to cancel (dismiss) the case.

Forms for the tenant

To respond to the eviction case, you start by filling out an Answer or other response forms. Then, you file them with the court. This gives you the chance to tell the judge if there are any legal reasons your landlord can't evict you.

Optional:  Cover Sheet for Declaration of COVID-19-Related Financial Distress  UD-104 If you checked 3(m)(7) on UD-105, file form UD-104 along with UD-104(A).  
Proof of Service by First-Class Mail - Civil POS-030 Tells the court that you had legal papers in a civil case - other than a summons  - delivered to (served on) the other party by mail. Lists the papers that were served and tells who they were served on, where and when they were served, and who served them. Also explains how to fill out this form. How to serve your Response by mail

Either side can file a request for a trial. If your landlord did and you disagree with something in the request, you can use the same form to file a Counter-Request.
